Terms of Service

Effective date: 24 September 2026

These terms are an agreement between Business Excellence Empire (“we”, “us”) and the company that uses Business Monitor (“the customer”, “you”), and apply to everyone who signs in on the customer’s behalf. By using Business Monitor you accept them. If you do not agree, do not use the service.

1. The service

Business Monitor is a web app for delegating work: you assign a task, the person responsible (the “doer”) is told by WhatsApp and email, they mark it done, and your dashboard stays in step. It includes reminders, performance views, roles and permissions, and an API.

2. Accounts and your users

• The customer’s admins create accounts for their own people and doers and choose what each can do.
• You are responsible for everyone you add, for what they do in Business Monitor, and for having the right to give us their names, emails and phone numbers and to message them.
• Keep passwords secret and tell us at once if you suspect an account has been misused.
• You must be at least 18 and able to bind your company to these terms.

3. Acceptable use

• Use Business Monitor only for genuine work messages to people who expect them. No spam, marketing blasts or unsolicited messages by WhatsApp or email.
• Follow WhatsApp’s and Meta’s Business and Commerce policies, Google’s policies for any Google account you connect, and Indian law, including the DPDP Act 2023 and telecom rules on unsolicited commercial communication.
• Do not upload unlawful, harmful or infringing content; try to break, overload or probe the service’s security; access another company’s data; or resell the service without our written agreement.

4. Your data

You own the data you put into Business Monitor. You give us permission to store and process it only to run the service for you, as described in our Privacy Policy. You can export it as a CSV download or through the API, and ask us to delete it when you leave.

5. Fees

Fees, billing and payment terms are set out in your separate agreement with the program through which you get Business Monitor. If that agreement conflicts with these terms on fees, that agreement wins.

6. Availability

We work to keep Business Monitor running and your data safe, but the service is provided “as is” and “as available”. We do not promise it will be uninterrupted or error-free, or that every message will be delivered: WhatsApp, email and Google are run by others and can delay or refuse messages. We may change or improve features over time.

7. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, business or data, or for missed deadlines caused by undelivered messages. Our total liability for any claim about the service is limited to the fees you paid for Business Monitor in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

8. Suspension and termination

• You may stop using Business Monitor at any time and ask us to delete your organisation’s data.
• We may suspend or close an account that breaks these terms, puts the service or others at risk, or whose access through the program has ended. Where reasonable, we will warn you first.
• After termination, we delete your data on request, as described in the Privacy Policy.

9. Third-party services

Business Monitor relies on services run by others: WhatsApp (Meta) via AiSensy, email providers, Google, Diamond Arena for sign-in, and our hosting and database providers. Their own terms apply to your use of them, and we are not responsible for their outages or actions.

10. Changes to these terms

We may update these terms. We will change the effective date above and give admins notice of significant changes. Continuing to use Business Monitor after that means you accept the new terms.

11. Governing law

These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute.
